1. About SoftNest

SoftNest ("we," "us," or "our") is a calming application designed for people with dementia. SoftNest lets caregivers and family members upload voice messages, music, photos, and videos that provide comfort and familiarity to their loved ones.

By creating an account or using SoftNest, you agree to these Terms of Service ("Terms"). If you do not agree, please do not use the service.

2. Accounts and Eligibility

To use SoftNest you must be at least 18 years old and provide accurate registration information. You are responsible for keeping your password secure and for all activity that occurs under your account.

One account may be used to set up SoftNest for one person living with dementia (the "Loved One"). The Family Plan allows multiple caregivers to share management of a single Loved One's account.

3. Free Trial

New accounts receive a 7-day free trial with full access to all features. No payment information is required to start your trial.

After your trial ends, your account switches to read-only mode — your uploaded content is preserved and the Loved One can still listen to saved messages, but you cannot add new content or change settings until you subscribe.

We'll send a reminder email before your trial expires so you have time to decide.

4. Subscription and Billing

Plans

  • Premium Plan — $9.99/month: Full access for one caregiver account.
  • Family Plan — $19.99/month: Full access for up to five caregiver accounts managing one Loved One.

Payment

Subscriptions are billed monthly via Stripe. Your card is charged on the same date each month starting from when you subscribe. Prices are in USD. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.

Taxes

Prices are exclusive of any applicable taxes. Where required by law, tax will be added to your invoice at checkout.

5. Cancellation and Refunds

Cancellation

You can cancel your subscription at any time from the account settings in the admin panel. Cancellation takes effect at the end of the current billing period — you keep full access until then. We do not issue refunds or credits for partial months.

Goodwill Refund Policy

If you're within your first 30 days of a paid subscription and SoftNest isn't working out for your family, contact us at support@softnest.app and we'll make it right. No fine print — just reach out.

Account Deletion

You may delete your account at any time. Deleting your account cancels any active subscription and permanently removes all uploaded content within 30 days. This action cannot be undone.

6. User-Generated Content

SoftNest allows you to upload voice recordings, music, photos, and videos ("Content"). You retain all rights to your Content. By uploading, you grant SoftNest a limited license to store and deliver your Content solely for the purpose of providing the service to you.

You are solely responsible for the Content you upload. By uploading Content, you represent that:

  • You have the right to upload and share the Content.
  • The Content does not violate any third-party rights (including copyright or privacy rights).
  • The Content does not depict anything illegal or harmful.

We do not sell, share, or analyze your Content for advertising purposes. Your Content is used only to provide the service you've subscribed to.

7. Acceptable Use

You agree not to use SoftNest to:

  • Upload content that is abusive, harassing, or harmful to any person.
  • Attempt to gain unauthorized access to other users' accounts or our systems.
  • Use the service for any commercial purpose other than as explicitly permitted.
  • Upload malware, viruses, or any code designed to harm our systems or other users.
  • Violate any applicable law or regulation.

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

8. Limitation of Liability

SoftNest is provided "as is" and "as available." We make no warranties, express or implied, about the service's reliability, suitability for any particular purpose, or fitness for medical use.

SoftNest is not a medical device or a substitute for professional medical or caregiving advice. It is a comfort and companionship tool. Always consult healthcare professionals for medical decisions related to dementia care.

To the maximum extent permitted by law, SoftNest's total liability to you for any claims arising from your use of the service is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, incidental, consequential, or punitive damages of any kind.

9. Dispute Resolution

We'd rather resolve issues informally. If you have a dispute, email us at support@softnest.app first and give us 30 days to resolve it.

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any unresolved disputes will be handled through binding arbitration under the rules of the American Arbitration Association, on an individual basis (no class actions).

10. Changes to These Terms

We may update these Terms from time to time. When we do, we'll update the "Last updated" date at the top of this page and, for material changes, send an email notice to registered users. Continued use of SoftNest after the effective date of any update constitutes acceptance of the revised Terms.
